Terms of Service

These Terms of Service ("Terms") govern your access to and use of the flor.cam website (the "Site") and your purchase of the flor.cam application (the "App") from flor.rgb LLC ("we," "us"). By using the Site or buying the App, you agree to these Terms. Your use of the App itself is also governed by the End User License Agreement, and purchases are subject to our Refund Policy.

1. Eligibility

You must be at least the age of majority in your place of residence, and able to form a binding contract, to purchase the App.

2. The product

flor.cam is a downloadable, local-first application for macOS and Windows. We describe its features honestly and label any staged or forthcoming features in-app and on the Site. We may improve, change, or discontinue features over time.

3. Orders, pricing, and payment

Purchases are processed by our third-party payment provider, Gumroad, which acts as the merchant of record for the transaction. Prices are shown at checkout and may change, but changes do not affect completed purchases. Applicable taxes may be added. On successful payment you receive a license key by email. You are responsible for providing an accurate email address to receive it.

4. License

Your purchase grants you a license to use the App under the terms of the EULA. License keys are personal to you and may not be shared, resold, or redistributed.

5. Free trial

We offer a free 14-day trial so you can evaluate the App before buying. The trial is provided "as is."

6. Acceptable use of the Site

You agree not to misuse the Site — including by attempting to disrupt it, access it in unauthorized ways, scrape it at scale, or use it to infringe others' rights or break the law.

7. Intellectual property

The Site and App, and all related trademarks, logos, text, and design (excluding third-party and open-source components, which remain under their own licenses), are owned by us or our licensors and are protected by law. You may not use our branding without permission.

8. Third-party services

The Site and purchase flow rely on third parties (such as Gumroad for payments and our hosting provider). Your use of those services is subject to their terms and policies. We are not responsible for third-party services.

9. Disclaimers

THE SITE AND APP ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, to the maximum extent permitted by law. We do not warrant that the Site will be uninterrupted or error-free. Nothing in these Terms excludes liability that cannot lawfully be excluded, including certain statutory consumer rights.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR FOR LOST DATA OR PROFITS, ARISING FROM THE SITE, APP, OR THESE TERMS. OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.

11. Indemnity

You agree to indemnify and hold us harmless from claims arising out of your misuse of the Site or App or your violation of these Terms or applicable law.

12. Changes to these Terms

We may update these Terms; the "last updated" date will change and continued use after an update constitutes acceptance. Material changes will be communicated where reasonable.

13. Governing law & disputes

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws rules, and the courts of the State of Florida, USA will have exclusive jurisdiction, subject to any mandatory consumer-protection rights you have where you live.
